🦷 BrushBucks Terms of Service

Important: By using BrushBucks, you agree to these Terms of Service. If you do not agree, please do not use the app.

1. Overview

These Terms of Service ("Terms") govern your access to and use of the BrushBucks mobile application and related services (collectively, the "Service"). The Service is provided by Kickstart AI LLC d/b/a "BrushBucks" ("BrushBucks," "we," "us," or "our").

By using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility & Parent / Guardian Responsibility

The Service is intended for use by parents or legal guardians to help manage and coach children's brushing habits.
Only adults (18+ or age of majority in your jurisdiction) may create a BrushBucks account.
Children may use the app only under the supervision of a parent or legal guardian and under that adult's account.
By creating an account, you represent and warrant that:
- You are a parent or legal guardian, or otherwise legally authorized to use the Service; and
- You consent to the collection and use of your child's information as described in our Privacy Policy.

3. Account Registration & Security

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials and any PINs or security codes.
You are responsible for all activities that occur under your account, including activities by your children.
You agree to notify us immediately of any unauthorized use or suspected security breach.

4. Subscriptions, Billing & Auto-Renewal

4.1 In-App Purchases

Certain features of the Service, including premium AI coaching and advanced analytics, may require a paid subscription ("Subscription").
Subscriptions are billed through Apple's App Store using your Apple ID.
Pricing, billing frequency, and free trial (if any) details are shown in the app at the point of purchase.

4.2 Auto-Renewal

Subscriptions are automatically renewed at the end of each billing period (e.g., monthly or annually) unless canceled at least 24 hours before the end of the current period.
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your Subscription at any time in your Apple ID account settings. Deleting the app does not cancel your Subscription.

4.3 Trials & Refunds

If a free trial is offered, it will convert into a paid Subscription at the end of the trial unless canceled before the trial expires.
Payments are processed by Apple. We do not issue refunds directly. Any refund requests must be submitted through Apple's official refund process.

5. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the BrushBucks app on a device you own or control, and
- Use the Service for personal, non-commercial use to manage your family's brushing habits.
You may not copy, modify, distribute, sell, or lease any part of the Service, nor reverse engineer or attempt to extract the source code, except as permitted by law.

6. Prohibited Uses

You agree not to:

Use the Service for any unlawful, harmful, or fraudulent purpose.
Attempt to gain unauthorized access to other users' accounts or data.
Interfere with or disrupt the Service or its infrastructure.
Upload or transmit any content that is illegal, abusive, harassing, or otherwise objectionable.
Resell, sublicense, or commercially exploit the Service without our prior written consent.

7. Health & Medical Disclaimer

The Service provides brushing reminders, educational content, gamification, and AI-generated feedback to encourage better oral hygiene habits.
The Service is not a medical or dental device and does not provide professional medical or dental advice, diagnosis, or treatment.
Any information or feedback generated by the Service is for educational and habit-building purposes only and may not be accurate or complete for clinical use.
You should always consult a licensed dentist or healthcare professional regarding your or your child's oral health. Never disregard professional advice because of information from the Service.

8. AI Coaching & Automated Feedback

Certain features, such as AI-powered coaching or feedback, may use third-party AI providers.
AI responses are generated automatically and may occasionally be inaccurate or incomplete.
AI coaching is intended as a motivational tool only and must not be relied upon for medical, diagnostic, or treatment decisions.
By using AI-based features, you consent to the use of your and your child's brushing-session data as described in our Privacy Policy.

9. User Content & Verification Photos

The Service may allow you to submit or generate content such as child names, avatars, brushing-session data, and optional verification photos ("User Content").
You retain any rights you have in your User Content, subject to these Terms.
By submitting User Content, you grant BrushBucks a limited, non-exclusive license to use, store, and process that content solely for the purpose of operating and improving the Service.
Verification photos, if enabled, are encrypted and retained only as described in the Privacy Policy (typically 48 hours).
You are responsible for ensuring that User Content does not infringe any third-party rights and does not contain inappropriate or illegal material.

10. Intellectual Property

The Service, including all logos, characters, designs, graphics, text, and software, is owned by BrushBucks or its licensors and is protected by intellectual property laws.
Nothing in these Terms transfers any ownership rights to you. You receive only the limited license described in Section 5.
Any feedback, suggestions, or ideas you submit about the Service may be used by us without obligation or compensation to you.

11. Third-Party Services

The Service may integrate with third-party services such as Supabase, Expo, Apple, and Groq. Your use of those services may be subject to their separate terms and policies. We are not responsible for third-party services we do not control.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or are creating risk or legal exposure for us or others.
You may stop using the Service at any time and may delete your account through the app (Settings → Delete Account).
Upon termination, your right to use the Service will cease. Sections that by their nature should survive (e.g., intellectual property, disclaimers, limitations of liability) will remain in effect.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA OR CONTENT WILL BE ACCURATE OR RELIABLE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRUSHBUCKS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

15. Indemnification

You agree to indemnify and hold harmless BrushBucks, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Service;
Your violation of these Terms; or
Your violation of any rights of another person or entity.

16. Apple-Specific Terms (REQUIRED)

If you download the App from the Apple App Store:

These Terms are an agreement between you and BrushBucks (Kickstart AI LLC), not Apple.
Apple is not responsible for the App or its content and has no obligation to provide maintenance or support.
In case of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if applicable). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession/use of the App, including: (a) product liability claims; (b) any claim that the App fails to conform to applicable legal or regulatory requirements; and (c) claims arising under consumer protection or similar legislation.
In the event of any third-party claim that the App infringes that third party's intellectual property rights, BrushBucks, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles, unless the laws of your country require otherwise for consumer protection.

Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Florida, USA, unless applicable law provides you with mandatory rights to bring claims in your local courts.

Informal Resolution: Before filing a claim, you agree to attempt to resolve disputes informally by contacting us at info@brushbucks.app.

Class Action Waiver: To the extent permitted by law, you agree that any claims will be brought in an individual capacity and not as part of a class action lawsuit.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top. We may also provide notice in the app or via email.

Your continued use of the Service after changes become effective means you accept the updated Terms. If you do not agree, you must stop using the Service.
